The Meeting of Creditors, also known as the §341 Meeting, refers to a meeting conducted by the Chapter 13 Trustee pursuant to 11 USC Section 341(a). At this meeting, Chapter 13 debtors will be required to affirm that the information that they are about to give is truthful and that the information contained in the petition and schedules is accurate. The Trustee or a Substitute Presiding Officer will ask the debtors about their Chapter 13 petition and schedules, including but not limited to, income, expenses, assets, debts, proposed plan, and other relevant issues the Trustee may wish to question. At the section 341, creditors will also have the opportunity to ask the debtor questions concerning their bankruptcy petition, schedules, and proposed plan.
As of October 1, 2023 the office of Thomas H. Hooper, Chapter 13 Trustee, will not conduct in-person §341 Meeting of Creditors at our office absent special circumstances and prior approval. All §341 Meeting of Creditors will be conducted virtually via Zoom video conference. Zoom can be accessed via a free app on a smartphone/tablet or on a computer with video/microphone.
